Rubin, 1 Misc. 3d 127A (A.T.2, 2003)[where Mr. Wendrovsky's clients (plaintiffs) in Brooklyn soughtdamages for negligence, trespass and violation of Real Property & Proceedings Law(RPAPL) 861 (involving damages to clients' trees), multiple motions by defendants for summary judgment dismissing trespass and RPAPL causes of action were denied; evidence established, respectively, that defendants entered onto plaintiffs' property; and that RPAPL does not require a trespass occur in order to impose liability; damages may be recovered under the common law and the RPAPL. if trees were cut down or despoiled, even without entry upon plaintiffs' property; and plaintiffs properly appealed from the order denying reargument, where court granted reargument by addressing the merits of plaintiffs' motion]
