Gerry Wendrovsky is involved in all areas of matrimonial and family law, including uncontested divorces; contested divorces; motions for pendente lite relief, and exclusive occupancy of the marital residence; motions for a stay(in the Supreme Court and Appellate Division); prenuptial and postnuptial agreements; qualified domestic relations orders(QDRO); post-judgment proceedings(including the conversion of a money judgment into a Supplemental pension QDRO); enforcement and challenge of both domestic judgments and foreign divorce judgments(including the forced sale/transfer of real property); and contempt proceedings, including the failure to pay child and spousal support .
Mr. Wendrovsky routinely prepares separation and settlement agreements, as a way to spare his clients the expense of protracted legal proceedings.
Mr. Wendrovsky has represented parents within the Family Courts and Supreme Courts(including the Appellate Division) of New York City, and elsewhere in New York State, in connection with their Hague convention enforcement and contempt petitions to return children to the United States from foreign countries(Canada/India/Romania); applications to return children from/to other states(South Carolina/Florida); applications to declare the (in)validity and impact of a foreign divorce(Dominican Republic/Sweden); motions to obtain child support and spousal support, child custody and child visitation; orders of paternity and filiation; relocation by a custodial parent's to another city, state or country; grandparent visitation rights; orders of protection; termination of child support and emancipation of independent children; child support arrears and spousal support arears; contempt proceedings; and child neglect and abuse proceedings.
He represents parties in the creation, enforcement and dissolution of domestic partnership, property agreements, settlement agreements, and separation agreements.
Mr. Wendrovsky is a member of the Matrimonial Law Committee of the New York County Lawyers' Association.
ADOPTIONS & NAME CHANGES
Mr. Wendrovsky has represented and assisted prospective adoptive parents in the obtaining of private party adoptions in the Surrogate Courts of New York City and Nassau County.
On many occasions, Mr. Wendrovsky has assisted in name changes of children and adults, in the Civil and Supreme Courts, within the New York, and the amending of birth certificates, through the New York City Health Department and the Supreme Courts of New York City. He has also successfully represented a client in opposing a last name(surname) change of a minor child in a reported decision.
